13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

- ANY DEFECTS IN THE SERVICE WILL BE CORRECTED.
YOU USE THE SERVICE AT YOUR OWN RISK.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RINGTIME, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50.00).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
15. Liquidated Damages
You acknowledge that violations of Sections 6.2 and 7 cause RingTime substantial harm that is difficult to quantify, including loss of competitive advantage, dilution of proprietary data and analytics, and harm to the integrity of the Service. Accordingly, you agree that the following liquidated damages represent a reasonable estimate of harm and are not a penalty:
- (a) $50,000 per incident of automated access, scraping, or unauthorized bulk extraction;
- (b) $100,000 per use of Service data, content, or output as training, fine-tuning, or evaluation data for any machine learning or artificial intelligence system;
- (c) $25,000 per incident of any other violation of Sections 6.2 or 7.
These liquidated damages are in addition to, and not in lieu of, any other remedies available to RingTime, including injunctive relief, actual damages, disgorgement of profits, and attorneys' fees. RingTime may elect at its sole discretion to seek actual damages instead of liquidated damages for any violation.
16. Indemnification
You agree to indemnify, defend, and hold harmless RingTime and its officers, directors, members, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit through the Service.
17. Injunctive Relief
You acknowledge that any breach of Sections 6.2, 7, 8, or 9 would cause RingTime irreparable harm for which monetary damages alone would be inadequate. You agree that RingTime is entitled to seek immediate injunctive relief, specific performance, and other equitable remedies without the requirement of posting a bond or proving actual damages, in addition to any other relief available at law or in equity.
18. DMCA Notice and Takedown
RingTime respects the intellectual property rights of others. If you believe content available through the Service infringes your copyright, please send a written notice that complies with 17 U.S.C. § 512(c)(3) to our designated agent:
